Duty of Care

In today’s society it is important to many people that when they get ill, suffer an injury or are generally worried about their health, that when they seek advice from doctors or hospitals they are provided with the up most duty of care, in order to make them healthy again. This duty of care is sometimes not reached and a lot of patients find themselves dealing with clinical negligence. Clinical negligence is not just about what goes on in the doctors or hospitals but also other care houses such as pensioners care homes and mental institutions. These are also places where a person has/is effectively putting the safety of their life into the care of someone else.

There have been many reports for instance, concerning pensioners care homes where the elderly who sometimes pay to be looked after, are simply being neglected to the point of abuse. a lot of inspections found that care homes around the country were treating their patients like useless objects rather than people, not helping them to bathe, use the toilet or even helping them out of the bed so they can get some exercise. This effectively is reported to have left some patients living in their own excrement and suffering silently in their beds. On top of this a lot of reports found that there was not a sufficient amount of cleanliness in the care home facilities and that not even cleaners were ensuring that the best level of health can be kept. This is just one area of medical negligence that has been reported to take place, but there are hundreds in many various areas of medical care that go on every day, to people who may not be confident or even healthy enough to speak up about it.

It is important that if you or a loved one has suffered from medical negligence and/or may not have been treated sufficiently enough, or has even had a serious of problems with regards to treatment or diagnosis, then a claim should be made. Accidents at work are sudden events that may cause physical and or emotional damage. Understanding a little about workers compensation and what to do if you are involved in a work related injury are important to both your financial and personal health. Workers compensation is a system that exists in all states that protects workers who become injured on the job or contract an illness because of contaminants that the employee was exposed to during the normal course of their job. When an employee becomes injured they file a worker’s compensation claim. Workmen’s comp is a no fault system that allows injured or sick employees to receive benefits which usually include medical benefits, and a portion of their salary. If you are involved in an accident it is important that you notify your employer immediately and fill out an accident claim form after you have received medical attention. Regardless of whether you think it is a long sustainable injury or something minor do it now, while all the details of who, what, where and when are still easily recalled. There are numerous times when an employee would try to file a claim because of a nagging injury that took place on an unspecified date. Because the employer was not made aware of the personal injury claim at the time it happened, it becomes more unclear and argumentative over whether or not the injury occurred while performing their job. In conclusion, accidents unfortunately do happen on the job. It is the employees responsibility to report the injury as soon as it occurs. It is the managers responsibility to investigate the claim. The reasons for this are twofold. First it helps to ensure the employee gets the medical care and compensation that they are entitled to by law. Second it is management’s right to investigate the accident and take appropriate measures to see that that type of accident does not happen again.

Asbestos is a Greek word that means inextinguishable. Asbestos can withstand heat and fire and hence it was named so. It became popular in the 19th century and many builders started to use asbestos in construction as it has insulating properties, tensile strength and flexibility. However asbestos is toxic. It can cause diseases such as malignant mesothelioma, lung cancer and asbestosis. The developed countries like the USA and many European countries have banned using asbestos in construction. However, a few developing countries like India and China continue to use asbestos. Most asbestos fibres are not visible to the human eye as they are too small. People who are exposed to asbestos at work are prone to get asbestos-related diseases such as asbestos warts, pleural plaques and diffuse pleural thickening. While asbestos warts cause skin diseases, pleural plaques and diffuse pleural thickening can cause lung diseases. In developed countries like the USA it is easier to make an asbestos claim for compensation if a person’s health is affected by this deadly material.
